Please read these terms and conditions carefully before using iTrainer, a fitness and wellness mobile application (the "App"). By using the App, you agree to be bound by these terms and conditions.

1. USE OF THE APP
   
   The App is provided solely for the purpose of assisting you in your personal fitness and wellness activities. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare providers with any questions you may have regarding a medical condition.
   
   
   

2. ACCOUNT REGISTRATION
   
   In order to use the App, you may be required to register for an account. You agree to provide accurate and complete information when registering for an account and to keep your account information up to date.
   iTrainer is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
   
   

3. USE OF YOUR INFORMATION
   
   iTrainer may collect and use certain information about you in accordance with our privacy policy. By using the App, you consent to such collection and use.
   The iTrainer: Diet & Exercise Plan AI app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the iTrainer: Diet & Exercise Plan AI app won’t work properly or at all.
   
   

4. INTELLECTUAL PROPERTY
   The App and all content and materials included in the App, including without limitation, the design, text, graphics, logos, icons, images, and software, are the property of iTrainer or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our App.
   By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to iTrainer.
   
   

5. DISCLAIMER OF WARRANTIES
   
   THE APP AND ITS CONTENTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
   
   

6. LIMITATION OF LIABILITY
   
   IN NO EVENT WILL ITRAINER, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, ANY CONTENT ON THE APP, ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP, OR SUCH OTHER WEBSITES OR APPS, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
   
   

7. MODIFICATIONS TO THE APP
   
   

iTrainer reserves the right to modify, suspend or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.

8. GOVERNING LAW
   
   

These terms and conditions and your use of the App shall be governed by and construed in accordance with the laws of the jurisdiction in which iTrainer is located.

9. ENTIRE AGREEMENT
   
   

These terms and conditions constitute the entire agreement between you and iTrainer with respect to the use of the App.

- By subscribing to iTrainer, you agree to pay the subscription fee on a recurring basis until you cancel your subscription. The subscription fee will be charged automatically at the beginning of each billing cycle, which is typically monthly or yearly, depending on the subscription plan you choose. You can cancel your subscription at any time by going to the subscription management section of your iTrainer account. If you cancel your subscription, you will not be charged for any future billing cycles, and your subscription will end at the end of the current billing cycle. iTrainer reserves the right to change the subscription fee or subscription plans at any time. If we make any changes, we will provide you with notice through the iTrainer app or via email. By subscribing to iTrainer, you agree to these subscription terms and conditions.

- Auto-Renewal: By purchasing a subscription to our services, you agree to our automatic renewal program. This means that your subscription will be automatically renewed at the end of each subscription term unless you cancel your subscription before the renewal date. The renewal will be for the same duration as the original subscription term and will be charged at the then-current price for the subscription. You authorize us to charge your payment method for the renewal term. You may cancel your subscription at any time by following the instructions in the "Cancellation Policy" section of these Terms and Conditions."

The app does use third-party services that declare their own Terms and Conditions.

You should be aware that there are certain things that iTrainer will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but iTrainer cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, iTrainer cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, iTrainer cannot accept responsibility.

With respect to iTrainer responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. iTrainer accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android, iOS & KaiOS – the requirements for the system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. iTrainer does not promise that it will always update the app so that it is relevant to you and/or works with the Android, iOS & KaiOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

- The application is considered a family place and is not allowed to be used for anything other than the reasons specified in its goals

- The application and the company have the right to file a report and reserve the data of people in case they violate the laws, and they have the right to stop and delete their accounts.

- If it turns out that the person who created the account is a bot and not a human, his IP will be permanently blocked.

- It is forbidden to publish advertisements, and the company is the one that allows such things. The company is not responsible for what people publish, and it is necessary to inform the company of any violation of its laws.

- The application is not responsible for entering wrong data that results in an error in the application’s outputs, such as diet, training, and other application features.

 - You should refer to the doctor in case of any disease before or after using the application.

- Therefore, you should check with your doctor before using any of the application’s outputs, such as diet, training, and other application features.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
